Reporting Misconduct – Whistleblowing

De.Na.Se Srl has adopted a process for receiving, analysing and handling reports, including anonymous reports, concerning the Company and submitted by third parties or by De.Na.Se Srl personnel.

The process complies with the new regulatory provisions introduced by Italian Legislative Decree No. 24 of 10 March 2023, implementing Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report breaches of Union law, and containing provisions on the protection of persons who report violations of national regulatory provisions, the so-called “Whistleblowing Decree”.

Who can submit a report?

Anyone may submit a report, including anonymously: employees, former employees, job applicants, partners, customers, suppliers, consultants, collaborators, shareholders and, more generally, anyone with a legitimate interest in De.Na.Se Srl’s business activities.

What can be reported?

Reports may concern suspected misconduct, suspected unlawful acts or alleged breaches consisting of:
  • breaches of internal company policies and/or, in any case, conduct capable of causing damage or harm to De.Na.Se Srl, including damage to its image or reputation;
  • unlawful conduct relevant pursuant to Italian Legislative Decree No. 231 of 8 June 2001, or breaches of organisational and management models, where adopted;
  • breaches falling within the scope of European Union acts and the national provisions implementing them;
  • acts or omissions that harm the financial interests of the European Union;
  • acts or omissions relating to the internal market, including, by way of example, breaches of competition and State aid rules;
  • acts or conduct that undermine the object or purpose of the provisions set out in European Union acts.
Reports must concern facts of which the Reporting Person is aware, where the Reporting Person has reasonable grounds to believe that the information reported is true at the time the report is made.

What should NOT be reported?

Disputes, claims or requests related to a personal interest of the Reporting Person that concern exclusively their individual employment relationship, or their relationship with hierarchically superior figures; communications or complaints relating to commercial activities.

  • Whistleblowing Platform, designed to ensure the confidentiality of the Reporting Person’s identity through the use of secure protocols and encryption tools. Once the report has been submitted, the Platform provides a unique identification code that allows the Reporting Person to check the status of the report and to send and receive communications, including anonymously;
  • Direct meeting with De.Na.Se Srl’s Whistleblowing Officer.

No form of personal or professional retaliation as a result of a report is permitted or tolerated. Anyone who believes they have suffered retaliation because of a report may notify the Italian National Anti-Corruption Authority (ANAC) through its online Platform.

All personal data is processed in compliance with applicable data protection legislation.
